The Improvement Notice

The Care Inspectorate took enforcement action against TNS on 9th November, 2018 and issued an Improvement Notice.

This followed the police-led investigation that had concluded that nothing had happened. It is our view that the enforcement action was illegal.

The following Freedom of Information request has just been submitted by the former Head of School to ensure that all interested parties have clarity on why the improvement notice was issued and in particular what evidence could justify the numerous conditions:

1.       By 1 December 2018, you must ensure that the safety and well-being of children using the service is being protected and promoted.

2.       In particular you must ensure that all staff whose role within the care service includes, at any time, the implementing of child protection policies and procedures,

3.       have sufficient training and expertise to ensure that they have a sound understanding of child protection issues

4.       and that they are able to confidently and competently implement child protection procedures

5.       by 21 November 2018, children using the service must be kept safe from inappropriate behaviour and (sic) by members of staff

6.       your whistleblowing policy and procedure is being adhered to and implemented

7.       staff recognise poor practice and inappropriate behaviour and feel confident and safe in disclosing this

8.       all disclosures of inappropriate behaviour are thoroughly investigated and action taken where necessary to protect children and ensure they do not recur

9.       staff are familiar with the terms of the whistleblowing policy and know how to implement it

10.   staff who have responsibility for taking forward concerns raised by whistleblowing have been provided with appropriate training and have embedded this in their practice

11.   by 21 November 2018, you must ensure the safety and well-being of children using the service is protected and enhanced when making decisions relating to their care

12.   put in place and implement a clear system of delegation about the making decisions which will affect children’s health, safety or welfare

13.   ensure that decision-making is not subject to any conflict of interest and is carried out in partially in the best interests of children
